Of course they can/will/should! This is also commonplace when Track/Course Racing. You, the Driver are still liable and consent to as such. Sucks to be him. What is reeeeeally interesting is how if any can the Porsche claim on Insurance for his 911 or the damage he caused...

It's more of a gentleman's agreement.
If I would were to smash my race car against another car I don't have to pay a cent. However that would be in poor taste and the NASA heads probably wouldn't be too willing to have me back.
But that's the risk, it's not a cheap hobby. Best to accept that early.
