Both Insurance and the Dealership are have the ability to take the hit. I on the other hand, in my opinion, should have zero impact financially from this situation for parts. I am just always looking out for how I can get screwed in the end with these big corporations because from my experience it happens 9 times out of ten. They are always going to find their way to get money from me somehow. Both insurance and the dealer.

You seem like you are well prepared and knowledgeable of the risks. I am sure you know, but don't accept the first buyout/total offer, there is always room. The insurance adjuster is trying to minimize their exposure.
Has the insurance company towed it off the BMW lot? Just curious. A lot of times insurance companies want to get it in their own yard to avoid paying storage fees. Not sure a BMW dealer would charge this.
