Good Example of Why BMW Owners Get a Bad Rep.

Ok, so I am looking for a little guidance and opinions. In fact, I think I'll take a poll. First, the story:

I was at a local dealership picking up my car and saw a car that has been talked about quite a bit around town (amongst the BMW community, at least). It's a Dakar Yellow E92 M3 with a full Vorsteiner kit and black HRE wheels. The owner has done a lot to the car incluiding $2,500 in a clear mask that extends from the front all the way up to the CF roof. Pretty impressive car, IMHO. Also very unique with the color. The individual program is not cheap and it's kind of a crap shoot on how the color turns out for a specific body style. In fact, I almost bought a Dakar Yellow E46 M3 back in 2005 until I saw it in person. It just didn't fit the car, IMO. So, I was excited to see it and the color actually worked really well on the E92. I was also excited to take pictures and share them with the comminity.

Here is the kicker and what addresses the title of the thread. As I was taking pictures with my iPhone, one of the technicians says "just be careful and don't post those on the internet, Mr. So-and-So [don't want to call the owner out] would be pissed."

So, I have 5 or 6 pictures, albeit not the best pictures, of a pretty unique Dakar E92 M3. Do I post them?

absolutely ridiculous. So the car can be driven around town, but no one is allowed to look at it? BMW has test cars all over the place that Im sure they dont want pictures taken of, but magazines do it, and publish them all the time.

Not worried at all about what the guy would do, it's more a question of whether I should respect his wishes. Good point, though...he didn't ask me not to post them. One of the shop guys said he wouldn't be happy if I did.

Sorry, unless that car gets put into an enclosed trailer, delivered to an enclosed garage at night, and then never driven, people are going to see it (and in Dakar, they'll be sure to notice it miles away). How's he going to stop people taking cell phone pics driving on public roads? He's not. So post away.

If he didn't want to be noticed/photographed/seen, he should have bought a beige Camry.

It could be a "show car" that is supposed to be unvailed at some sponsors booth/show/event? If the local community is talking about it, but hasn't seen it, that is more support for this idea.

Legally there's no issue unless you use them commercially or to slander and/or libel someone (I'm a photographer/filmmaker) Any image can be taken of anybody or anything provided it's on public property and you did not trespass to produce the images.

That said, the proper thing is to ask first. If the owner really does not want pictures shown publicly for any reason, then you should not do it out of respect for that person. In the end it's up to your own ethical philosophy.

If (the odds are pretty slim) the person sees the images on the net, and realizes they came from the dealer, then the tech may very well get reprimanded for allowing you to take the pics in the first place. After all, the dealership is on private property.

It's totally up to you; I guess you feel the pics are that important to post(?)

Go ahead and post them. Anything that's out in public is fair game. That's why automakers try and camoflage new models as they develop them - they know people may take pics. Would you even be asking if you had seen the car parked outside a 7-11?

I have no real interest in seeing Dakar Yellow, but i say post BECAUSE of the suggestion that you don't. If celebs are not afforded the luxury of even a moments privacy should someone's car??? Like someone said, as long as you aren't claiming it's yours or using it in an ad or marketing bit, post away!
