This would never be a court case. The quoted time in the ads comes with a disclaimer that they only represent a preliminary test BMW AG did and may not be what the consumer gets. I'm not saying it doesn't suck for those who expected more, just there appears to be no legal case here.

Problem is, when used for comparison, it shows these to be quicker than the competition, as well as the other N63TU3 vehicles, which I'd be willing to bet is why a large percentage of us purchased them. Thats not reality though. In fact the other TU3 vehicles are all quicker. In reality, my life would have been much easier with an X5 M50i, or even an X3 M Comp, but I got this because it was supposed to be quicker.

Beyond that, wonder why they don't want customers verifying.

I am in agreement. I sent an email to BMW customer relations today and will continue to press. Our only leverage is to give bad reviews to any organization that will listen such as JD Power, Consumer Reports, etc. to shame BMW into reprogramming our cars to perform to at the level that what was stated by them. If I don't get a suitable response from BMW, then I will contact Roundel and ombudsman for help. Maybe a letter in the Roundel telling people to avoid the M550 would get their attention.

I still think a petition on change.org would make a bigger difference (i think they send emails everytime someone signs the petition, so bmw would get spammed by it) specially if it catches the attention of the media. Someone with good writing skills do a good write up for the petition?

(full disclosure, I'm on page 7 of this thread and on a plane about to take off, but had to remark on yet another idiot who didn't read the thread and who thinks we all really want M5's).

The bottom line is you should get what you pay for especially if your decision was based on marketing. My salesman kept saying to me "I know you Joe, you should wait for the 2021 and the huge increase in performance". I didn't and I bought a pre-LCI but I'll tell you, I'd be ripped if I waited, paid more and got a slower car.

I just got another call back from the Customer Service rep. Missed his call, but on the voicemail he said he was going to talk to the dealer and regional rep to try to get a better view of what is happening, then give me a call back next week.

As far as a Petition goes, I'm in, but I can't write it. My writing skills aren't that great and in situations like this I always end up getting annoyed and using loads of profanity. You know, "Once a New Yorker, Always a New Yorker"? It applies to me.

Most of us are using a Dragy. Its a GPS based timing device.

I just got an update e-mail from the "Escalation Specialist" at Customer Relations. They're still actively researching the case. They'll get back to me when they find something out or no later than next Friday.

Well, boys and girls, I actually just sold my 21 M550. I was very frustrated with the launch and the other stuff that was going on with it...

Now I'm on the hunt for M5. Didn't realize there was a shortage of vehicles till i signed my M550 away. I think i will miss the smooth and soft drive of the M550...
Oh and i bet you they will solve the launch issue and a tune will come out for this vehicle since i jumped out of the boat.. 😂

Mike- if there's a way to tag more people to your case let us know. I'd be willing to share my VIN and contact info. It might be more effective for the escalation person to have a 5-10 car case than 1.

Good luck DB_BMW I jumped ship too, but I never took delivery of my ordered 550. My dealer got a 21 M5C in on trade and extended me a very favorable discount especially considering you can't find any. Very happy I was able to make the switch. I hope you made out well on your sale of 550 considering they are as hard to find as M5s and the pre- owned mkt is en fuego 🔥

I have a 550ix inbound and I'm not terribly concerned about 0-60 right now. I figure someone will hack the ECU soon and offer a tune. I got the 550ix since I figured the m5 might be a shade on the harsh side plus it was 20k more. I think this issue gets sorted out soon.
