My Warranty VOIDED. Now What.

Long story short, my HPFP failed on my '09 E92 with 6k miles. This happened after picking up my car from the body shop where the repairs where done to my car.

I got about 5 miles away from the body shop, and she sputtered, clamored, gasped for fuel, and clunked out. I had no choice but to call BMW and have them come pick us up. I was on the busiest highway here in town, and there was no way I could just leave it.

So, I called the Sales Associate involved in the other thread, and told him that we were coming in. I told him how worried I was about my mods, and if there was anything he could do to help, I'd appreciate it. He conferenced in the Assistant Service Manager, and we talked. He said to just come on in, they'd set me up with a loaner, and yes, it sounded like the HPFP.

This was yesterday afternoon. Well today, he called me and said "Bad news. Your car threw over 50 different codes. We reset them all, and started it again, and ten of them threw again. He said they are all related to tunes and modifications. It is the HPFP, but it's not going to be covered under warranty. I talked to the Service Manager, the Regional Service Advisor and we emailed BMW with a list of the computer readings. For all intents and purposes, your warranty is gone."

Me: "So......you and I both know there is a major problem with the quality and dependability of these fuel pumps. Nothing I did affected this outcome. It's not fair, and what if it happens again...and again? Furthermore, I have countless examples of other owners with the same mods whose pumps have been replaced under warranty. What about that inconsistency?"

Him: "Don't know what to tell you, boss. You can come up here tomorrow and meet with the Service Manager, but what's done is done. We don't control what BMW says/does."

So people, WTF. What's my play here, if any at all?

i'm really sorry to hear that. I would tell them i want to see the printout of what codes were thrown. have them prove to you how it was linked to your tune. Chances are they can and will show you that the tune was detected, which sucks, but dont go down without seeing the proof.

Sounds like you are going to be out of pocket on this one man, has anyone had their HPFP replaced by a shop other than the dealer yet? I'm sure you can save some money over a dealership somehow....

Yeah I already checked the price on Tischer. It's only $200 plus shipping. I can't imagine it's more than a few hours labor, so maybe I can come out under $350, which would chap my ass but not be a total kick in the nuts.

I'm really going to press the issue that they prove it is directly related to my mods. I think they're going to have a hard time, especially when they see that I know how big of a problem these pumps have been...and obviously continue to be.

man... i think you're fucked. think they have probably removed the warranty for your vin nationwide. guess jb3 really fucked it up. sorry to see this.

I was under the impression that the best a dealer can do is DENY warranty work, but BMWNA has to officially VOID your warranty.

You should have towed it to a repair shop or your house and taken off all your modifications before going to the dealer. NEVER take your car into the dealer with mods on it unless you want to get hassled.

Sorry to hear that man; I hope they give you a break on the price; BTW, why didn't you take out the JB3 before you called BMW to come and pick you up?

edit: I didn't see you above post regarding the removal of the tune; Was it your sales guy or your service advisor? If it was your sales guy, I can't believe that he/she told you not to take out the tune; always take out the tune just in case; as for the codes, that's why I carry my BT and mini laptop in my car at all times.

If there is any inconsistency, it might have to do with the fact that BMW is going through some hard times as a company currently, so getting them to be nice and replace a fuel pump under warranty for a claim they do not have to honor (since they technically do not have to given the chip), is going to be tough right now.

Sorry to hear about that bro, hopefully the SA can help you out somehow

im sorry dude. always remove ur tune no matter what. even if they didnt get any codes, it's obvious they see the tune inside the ecu.. i don't think it's JB3 that caused your pump to fail since we already know they are crap to begin with but having the tune sitting in there just calls for trouble.

i would call AAA to tow it back to my house or shop, remove everything b4 taking it back to BMW.

If they tried to hook up to the dme while the piggyback was still on it will definitely cause some issues. I'm surprised they were even able to hook up without any issues. Man all you needed was a 8'' socket and a needle nose screwdriver to uninstall it in less than 20 minutes.

my question is why were there so many codes and what were they.I mean all the codes couldnt have been from the jb3. I know mine was out when I went to the dealer but even so there were no strange codes. that really sux man, sorry to hear.

Dude. This sounds like total BS. I read the other thread. Sounds like the stealer is totally covering their ass. In this economy, I'm surprised the guy who wrecked your car has a job. Oh well, with sales down, it's not for long anyway. I don't know if there's anything you can do, but I'd take it to a trustworthy mechanic and see if they are pulling your chain. A voided warranty at this stage could be trouble. Even if they prove your mods caused xyz...that shouldn't void everything covered. Maybe just partial.

if i were u i would tell ur SA, "look i told u i would take the tune out and u said i didnt need to, then u go and have my warranty voided without so much as a phone call before hand? the only reason the car was at the body shop in the first place was because u fucked it up. i helped u out by not telling ur boss about this and then u go and dont show me the respect i showed u? i can still tell ur boss, even if my warranty is in fact voided at least u and i will BOTH be responsible for our mistakes.

im pretty sure the JB3 plays with the fuel pressure directly, but if it doesn't, then i dont see how they can void it because of your tune since everything the DME does, from my understanding, only adjusts WITHIN FACTORY SPECS and if it had to resort to such lengths that isn't plausible then that's where the limps come into play, no?

Yeah hindsight's 20/20. However, it was the middle of my work day, I had clients waiting on me, and I couldn't leave it sitting on the highway. Other things took priority in the heat of the moment. I should have been better prepared, though, as it's been showing signs of clunking out for a few weeks now. I have a JB+ just sitting here at home. As soon as I got it out of the body shop, I was going to take out the 3 and put in the PLUS. All I needed to do was get home.

Oh well. I guess it's the price we pay for doing what we do. It still just doesn't seem right, since we know it's a shitty part to begin with.

And I wonder how that will work? Will the replacement be warrantied?
