N54 335i Exhaust valve repair?

I might be the only person in the UK who would like their 335i to be quieter on the motorway.

Having owned the car (2010 E90 SE) for around 2 years the drone of the exhaust under very light loads at motorway speeds has irritated me since the start.

Over Christmas I investigated the operation of the flap and via trial and error have deduced the the actuator that is part of the left hand branch of the exhaust remains open at all times. So it is as if I have the Golf Tee modification in place when I don't.

The valve can move freely if moved by hand. However, when applying suction directly to the actuator rather than from the engine via the valve in the boot area after moving about 2mm the suction is lost and it returns to the open position.

I suspect that the rubber diaphragm in the actuator is faulty. Has anyone had any experience of repairing this item as it isn't available other than buying a whole left hand branch of the back box at about £380?

Why would anyone fit a mechanical part in a hostile environment that can't be replaced.

All suggestions welcome, Thanks.
