I've got a 340i incoming on 18" wheels, tyres are 225/45/18" on 8" fronts and 255/40/18" on 8.5" rears.

I've a set of winter tyres in sizes 225/40/18 and 245/35/18 coming off my outgoing 2er before I hand it back. Obviously they'll fit the 3er's wheels but will they be legal/safe/recommended given the drop in profile? The speedo will overestimate by about 5% won't it? But apart from that, any issues? particularly with insurance or the law?

Other than the speedo issue, the handling may be compromised.

Your insurer may refuse to pay out in the event of an accident,as it as it would be classed as a modification. You would have to disclose it to be sure.

I'm with LV and winters only don't count as a modification if they are tyres listed in the door card and on wheels available with the car.
