Running tires with different tread depth
I'm in the market for used tires, and I found a listing on eBay of a used pair with 10/32 tread on one tire and 8/32 tread on the other. They would both be used on the rear axle. Are there any problems using tires with a 2/32 tread difference?

According to this
http://www.tirerack.com/tires/tirete...jsp?techid=236 Minor differences in tread depths between front and rear tires (up to 2/32") are allowable and permit rotating tires. So you might be OK however it doesn't seem like a good idea if they are both on the same axle. Do you have all wheel drive or rear? If you have all wheel drive its commonly known to keep all tires even to avoid damage to the vehicle. You may be able to have a tire shop shave down the 10/32 to match your 8/32 as a last resort.
