Anyone successfully utilize the 7yr/70,000mi California Emissions Control Warranty?

I have an issue with my 2011 335i where it’s becoming more clear that I may have a failed turbocharger.

Has anyone had success having a dealership honor the extended 7 year 70,000 mile warranty on defective parts covered under the California Emissions Control Warranty? Page 31 states that New Jersey is a covered state (where I reside). Page 45 shows that the turbo charger is covered for the 2011 335i up to 7 years, 70,000 miles.

Any experiences to share? Was the total bill for the repair covered?

I (and other diesel owners) have certainly had issues covered under the CA warranty. For instance, I had my SCR metering valve replaced just before 70K, and then my mixer replaced at 74K under it (the valve didn't fix the problem.)

You may have to fight, and talk to the service manager (not the advisor). Don't threaten, be firm.

Okay next question— just called the dealer and determined I’m four months outside of the 7/70k Warranty. What’re the odds the service assistant/manager approve my repair? My talking points— long service history of car at the dealership, premature failure (46k miles but have been diagnosing for some time), and likely to purchase BMW from dealership in the future. Any thoughts?

If they have a record going back before the warranty ended, they are MORALLY and perhaps legally required to fix it under warranty. Certainly you should point out the service history, and ask them to fix it.

What exactly does this mean?
