RTA - Question for our BIB
I was hit in the rear on Monday afternoon; only minor damage to my rear bumper but it will however need replacing.
The other driver stopped and was reluctant to give me may details preferring that I get a quote and he would pay for the damage. I took photos of the area and both cars - along with the damage. The other car was quite old and to be fair, I couldn't see any damage to it (it had quit a large protruding front bumper) In the end, all I could get from the other driver was a name and mobile number. I called the other driver when I got home and again asked for his address so I could report it to my insurer which again he avoided and hung up on me. I reported it to my insurance giving them all I knew (car reg, make, model, colour, location of incident, drivers name and mobile number) I told the insurance I couldn't get an address out of him and they said it was ok as they had the reg and they could see who I was insured with. Now, thinking about this a bit more, and his reluctance to give details, I'm going to stick my neck out and say he either wasn't insured or didn't have permission to drive the car at that time. An askMID check says that the car he was driving is insured by someone - I'm just not convinced it was him although of course I could be wrong. Anyway, my question(s). Should I report this to the police? Reading online I should do this within 24 hours? Am I likely to get any repercussion for not reporting it sooner? TouringPleb and others - any advice appreciate.

Deffo get it reported to the police Rukka, I had a guy hit my old Vauxhall whilst he was doing a turn in the road, i got out to tell him what he already knew and he drove off. It could be seen as withholding information i would guess at the scene of a crime. The police later tracked the guys down and he gave a name and address of someone else who turned out to have been deceased for 2 years oh dear ..... anyway he did get his day in court and had to pay for the damage, seems very weird he didn't want to pass over the information, as you say either not the named driver or no insurance me thinks.

Cheers for the thoughts guys. I've just spoken to my insurance again and they are adamant I don't need to do anything further though.
I don't know if reporting it would create more hassle or not.

Definitely call your local police on 101 or look at their website for other ways to contact them. Tell them the other driver is refusing to give insurance details. They will want to know where, when, any witnesses, and dash cam footage etc. If you have the what3words app give the location using that.

My understanding (and I'm not great on traffic law) is that you don't have to report damage only rtcs to the police, drivers just have to swap details, name, address, insurance.
If one fails to do so, ie the other bloke hasn't and now won't give you his insurance details then it becomes reportable. You can argue you've been chasing him for the details and you are now reporting it because he's refusing to do what he's required to do by law. |

I've now reported it and made a statement. Let's see if anything happens..... Car going in for repair tomorrow

Already registered an interest in the 440i before this happened and had a conversation with a dealer to look at one when they are available in the flesh. To be fair, it's only a bumper scrape so I'll get over it and I'm in no rush to swap. I quite like the TTS despite it already having shat the diff and requiring replacement at 5000 miles. M440i will very much depend on a) decent discount/low apr and b) some decent colours as what is available now doesn't really blow my skirt up.

Happened to me many years ago. Hit twice (panicked I guess) in the rear.
Couldn’t get insurance details from the driver but had address, reg and mobile number. I also had legal cover on my policy so calling my insurer set my mind at rest. I had to pay 500 quid for my excess. I chased my insurer regularly for updates and I probed if I should go to the police if you can’t get the details. I was told no on many occasions. Cue 6 months I get a letter saying the matter was closed as the third party didn’t reply to the letters. WTF of course she wouldn’t I’d also left it too long for the legal cover. How convenient, had my car repaired by some shitty coach works place so they lost interest. They also suggested I should have gone to the police. Couldn’t make it up. I put it down to a life lesson, was young and couldn’t be arsed with the hassle of pursuit. good luck OP |
