Drunk In Charge Offence

Asking for a friend

So one of my employees was caught drunk in charge (asleep behind the wheel with the engine running), didn't dispute it, got a six month ban. I kept him employed and hired a driver because he's a good egg and it was totally out of character.

Ban ended at the end of Feb, however he can't get his licence back until he has a medical. Obviously every medical that had been booked has been postponed to the point that now the DVLA are saying that they will "be in contact when one is available".

Do any of our forum member have any experience of this or can offer advice as to how I can get his licence back quicker? The 6 month ban is going to be 12 before we know it and I could do with him being able to drive.

Im guessing it's being cancelled due to C19...in which case not a lot any one can do?

Yeah. Our thoughts too, posting in the hope of someone having knowledge of a way around it. Ultimately it's a (relatively self-inflicted) restriction of trade and could (probably should) result in his dismissal, purely because of a technicality.

Plenty offering and performing medicals for HGV licence renewal. Suggest he contacts one of them rather than going through his GP.

Nothing private available with BMI / Bupa etc? I'm at a BMI on Monday for a thing, to the outside world they're closed for business and helping the NHS with cancer patients, but they're not turning away paying punters.

You can only call and find out before arranging anything

It seems the only difference to a an HGV medical is the addition of a blood instead or urine test

Why does he need a medical now? Would he have needed the medical if he hadn’t lost his licence.

No, it's because of the amount of alcohol in his system I assume? It seems OTT to me and I've asked him to speak to his solicitor on Monday along with the company suggested above

Don’t forget to tell your insurance company!

Story:-
A few years back, a friend & colleague ended up with a DD ban.
He originally had a leased company car - which obviously had to go - but managed to continue working for the company throughout his 18 month ban.

After getting his licence back, then re-gained a new company car.(New Beemer).
Again, company lease contract.

Some months later, his house was broken into overnight.
Car keys taken and used to steal the car off his drive.

The insurance company (provided by the company he worked for) refused to cover the theft, because they had not been informed of the DD conviction.

The company had to replace the stolen lease car.
He then had to transfer on to the 'option' scheme, because the insurance premium hike to put an X- DD on the insurance was so viscious.
They wouldn't pay it.

Nasty mess.

Everything at the DVLA is mega slow right now. I recently had to get my drivers license changed from a full one the expired in 2054 to a medical shorten license that expires in 3 years - 2023. This took from beginning of April - June. I know not quite same situation but... it took time and DVLA couldn't even be contacted on the phone to check where it is.
