Fighting a Speeding Ticket
So it's time to go to court again on Thursday to fight a small ticket. I was going about 72 in a 50 zone and he knocked it down to 55 in a 40 zone which I found odd. He didn't get the speed of the zone correct on the ticket. Anyhow, any advice on what I should say or do? I hate having tickets on my record, no matter how small.

Fight every ticket. I was listening to AM640 on the way in to work on Friday (IIRC) and an insurance adjustor called into the John Oakley show and was talking about how insurance companies don't look at whether or not you have any points taken off. All they look at is whether or not you have a conviction re: a ticket against your record. If you do, no matter how big or small the ticket/fine, your rates go up.

I heard you can get someone to go in for you to say that you can't make it and then they have to reschedule the trial. Is that true? And then you have a better chance the cop won't show up.

no, because your re-scheduled date will be on the next date all of that cop's trials are happpening.. so its not just you and the cop... its you, 30+ other ppl, and the cop so he can get all of you in one shot instead of constantly returning to court for each individual person.

Yeah, I totally forgot about it. Oh well, next time I'll be more diligent. Anyhow, is a place on the ticket where the officer indicates that he lowered the infraction on the ticket? He lowered it from 72 in a 50 zone to 55 in a 40 zone.

Should be an "R" on the bottom somewhere... this means that if you fight it, it can be brought back to its original speeding charge

if your in the states, ask the prosecutor for an unsafe driving plea, the tickets a little bit more money, but its no points. You can only use this twice in 5 years, so be carefull.

hey, I am always curious about the accuracy of the cop's speed detector or speed gun....
do they have print out evidence of your speeding report? I've been pull aside once and they said, you are speeding, you are doing 95 speaking about technologies, what's the proof? I like to see a picture or piece of paper that shows my license plate with the over speed limit. unless you are talking about cops always win no matter what happen....

You can always use the argument if lidar or radar was properly calibrated and operated by officer as your defence argument, but you better do your homework on how to go about it. Traffic ticket is the official piece of paper that's given to you that has your license plate, HTA infraction and etc. Cops don't always win if you know how to fight the tickets and use information that can be found if you only take time to and don't leave it to the last minute... considering on average depending on the municipality you get at least 6 months before court appearance.
