Pre LCI vs NON LCI rear rim offset??

Are the rear fenders different on a pre lci vs a non lci?

as i was looking into purchasing rims and was told that the offsets for lci should be different than pre lci

I have a 2011 e90 and was going to put a 19 x 9.5 x 33 rear, but was told to get a 40mm rear because of the year of the car

can someone please clarify

Um, pre-lci is the same as non-lci
Assuming you mean difference between pre-lci and lci (which you have), the rear track is 8 mm wider on each side for the lci, hence the reason a more conservative offset is needed. However, you can easily run a 9.5" wheel with ET33 and a 265 tire in back.

the car will be lowered btw

which means 33mm offset on an lci is really 25mm on a pre lci, which is too aggressive when lowered i assume

the fender will be pretty close to the tire

Fenders are identical, but the track on the Post-LCI is widened by 8mm like Mass has stated. So a slightly more conservative fitment will be needed.

^ +1 the 19x9.5 ET33 with a 265/30/19 tire will work in the rear of your E90 LCI. If you're planning to drop the car though I would recommend that you go with the 19x9.5 ET40 in the rear to prevent any rubbing issues especially if you're not looking to roll your rear fenders.

What would your offset recommendations be for 20's with H&R Sports for an e90 LCI with no fender rolling? I have been talking with Vossen Wheels and this was their recommendation:

20x9 +35 offset with a 245/30 tire and a 20x10.5 +42 offset with a 285/25 tire. Perfect fitment. No rubbing

Thoughts?
