E.R. and aFe would be equal in Kw & Nm gains, but you do know it is illegal to have a catless down pipe on public roads?
The aFe is a solid unit, whereas the ER has a flex section, which ER uses as a selling feature.
If you do go ahead with the ER, you will need this as well to prevent CEL form coming on.

Second after a tune, a catless DP gives best bang for bucks in power & torque improvements.

Note from aFe's 328i dp web page:

Note: This is a "Race Only" product used solely for competition. Its use is limited to closed-course and open-course racing that is formally sanctioned by a recognized racing organization. Any other use including recreational off-road use could be in violation of local, state and federal laws. A check engine light will emitt and aFe recommends using a programmer but it is not necessary.

I've read that as wel, but since I'm getting bms do I still need that cable, I though bms will get rid of any code from the dp as well?
Has the ER fixed its fitting problems too?
Also what will happen if I get caught for using catless dp on public roads? How large is the fine?
Also ER didn't say to use their dp only on closed roads like what afe has advised.
Because ER has flex section, do u think to gonna make turbo sound louder compare to afe?

Ok, so let's go through your questions in order.

Now, according to BMS, the JB S1 does NOT throw any codes, BUT if you really want to be sure, you need to buy this product from them: It will delete any N20 codes.

Although I have read about catless downpipes, I am not interested in them because they are illegal to use on public roads. You may never get caught with a catless dp whilst going about your daily drive. However, if your car is involved in a collision, which sustains major damage and your/other parties' insurance assessor finds out you had a catless dp installed, they will probably not repair your car and report it to VicRoads - at least that's how I see it going down. I don't know the consequences - fines and/or otherwise from VicRoads - of illegally modifying a vehicle. If anyone else has additional info, which can help, please post it.

It doesn't matter whether Evolution Racewerks state or don't state where you can drive your car without a catalytic converter on public roads. Here in Victoria, as well as pretty much every state & territory in Australia, deem it illegal. That in itself is enough to not considering installing the catless dp.

Nevertheless, ER do state that their catless dp is illegal for use on public roads here: Scroll down towards the bottom of the page, just before the T-shirt photo.

ER's dp has a flex section because BMW's OEM dp has a similar flex section. I don't know whether the turbo will sound louder from aFe compared to ER.

If not already available, a 'high flow catted' version of the DP will be available soon. This will still allow power gains over stock, albeit slightly under what a true catless system would offer.

ER stuff (of course)... it's in my F30 Products Listing, under perforrmance, I've just checked my prices (which were pre-release) prices against some o/s competitors and realized I'm a bit exxy, so will be revising these downwards shortly to be more competitive
