Sounds like you have some kind of tune installed? If so you might be sol if something serious is wrong as they will almost surely discover the software change.
Best bet would have been to have it towed anywhere but the dealer first to uninstall the tune, but I'm not sure they couldn't still find shadow codes anyway. I feel your pain man, but sometimes shit happens like this and it's the chance you take when you walk down the path of adding mods related to the drivetrain. Hopefully it'll all work out though.

Well it's a good thing you mentioned that the car is "flashed" here. Seriously what's wrong with people posting stupid things on a public forum. Good luck getting it fixed; we we're just talking in another thread about finding one of these cars dying while driving to possibly start a class action suit.

Let me get this straight... You are swapping out parts designed by some of the top engineers in the world because some guys sponsored by a company told you it's "better??" But when you ask the same guy about tracking, "oh no, I have a kid now" or "I just detailed my car." or "i just got new tires."

Legally, they have to prove what was done to the car, if anything, was directly responsible for the failure.

Legally yes. But with a dead engine and a flash potentially at fault they have engineers and lawyers a plenty to argue with your Indy down the road.
That said, if it is mechanical or fuel supply related they'll probably good will it without looking at ECU. I'd challenge 10 hours labour to diagnose an ECU issue if that is what it turns or to be. |

ya this is one thing that i always thought of. People always say you can flash back to stock on certain mods before going into the dealership. but it sucks if your car blows up on the road when you are miles away from home.

i know in the heat of the moment it can be hard to make decisions... but i would have handled this a bit differently.
right away i would have had a family member or friend or someone bring the laptop and flash back to stock. i would have probably cleared all the faults too. the tune you speak of, in my case anyways, leaves a big list of error codes after flashing... they are "false alarms" probably caused by the flashing of the ecu... once i flash, clear the codes, they never return. id then try to start the motor up a few times. im sure that would leave some sort of error codes seeing as you'd get nowhere. and at worst i would have paid the tow truck driver an extra 200 or 300 to stop at the walmart / etc parking lot for an hour while we waited for friend / family to roll by with the laptop so i could at minimum flash back to normal. i think this is the biggest risk with all tunes... not the tune in it self, i have been running mine for about 4 months now... put on about 6000km on it, works great, love it every bit... but for those still in warranty, thats the risk im talking about... that if something DOES go wrong, bmw will finger point at the tune saying its the cause... when we all know it probably isnt... judging by the 100's if not 1000's of people (including myself) running a tune without any issues. just my 2c. best of luck tho hope everything works out and the hit on the pocket is minimal. --- just to be clear, i'm not knocking tunes or the specific one the poster mentioned. i have one and love it. just stating that if i were in warranty, and had my warranty at risk... i would think a lot harder then i did this time around before installing it. also i do not know what bmw's policy is in such cases... just guessing, but it would not surprise me at all if they had a step by step on how to get out of paying out warrant claims... one of these steps undoubtedly is to check if anything done to the car could be blamed (rather then could have caused) for the issue at hand. remember, the people who handle their finances are there to make money, not make customers happy or beautiful cars. once again, best of luck. |

Per the popular tuners on here, the tune is undetectable by the dealership. Someone would have to fly in from BMW corporate with a special tool in order to be able to detect the tune. I guess we will see if that happens or not...

Also, if your engine blows up there will be no need to worry about cold start (as the engine wont be able to start at all). |

For the people comments about reflashing (having a family member or friend come) while blocking a lane in the tunnel....fat chance. Sure, maybe on the side of a road somewhere with space, but most likely not going to happen in a tunnel.

of course not.
but having the tow driver stop somewhere on the way to the stealer is not so far fetched. i have had a tow driver 'pause' in a mall parking lot a number of years ago (different situation) for an hour. from what i recall, 150 bucks did it. all i am saying is if there is a potential of $XXXX or even $XXXXX coming out of my pocket, i would have no issue asking the tow driver to make a detour on the way to the stealer for a couple hundred. that is all. |
