Throttle Actuator Replacement Under Emissions Warranty?

My 2011 M3 is experiencing symptoms of a bad throttle actuator. I have read that a few people have been able to get this replaced under the emissions warranty, but that is varies based on state and most of these people who have mentioned it live in California.

I live in Oregon, does anyone have a guess whether this would be covered? My car is under the year and mileage for the federal emissions warranty, which I think is 8 year 80k miles.

The dealership wants me to pay $160 to diagnosis it before they will say whether it is and if I know that it is not, I would like to avoid that.

I thought BMW NA extended the warranty period of those to 10 yr / 100,000 miles. It was on the service record print out the BMW dealership gave me.

Anyone?

This not correct. The 10 yr warranty was for the engine idle control device, NOT the TA's.

To OP's question, yes you should be able to have the TA(s) replaced under the emissions warranty as others have.

It would be covered under the California Emissions Control System 7 year/ 70k warranty, if you live in one of the listed states. From the warranty booklet:

"The California Emissions Control System
Limited Warranty applies to all 2011 U.S.-
specification BMW vehicles registered in
California, Connecticut, Maine, Maryland,
Massachusetts, New Jersey, New Mexico,
Oregon, Pennsylvania, Rhode Island, Vermont or
Washington"

So, you should be covered in Oregon.

As for the diagnostic fee, if the car is throwing TA fault codes, they shouldn't even need to charge you that. Is it throwing codes?

No, but I'd imagine it has something to do with emissions regulations being stricter in those states, or perhaps consumer protection laws are stronger, or a combination thereof. I know here in PA, we have to get emissions inspections done annually (what a racket!), unless we are way under the mileage limit.

Thanks! My guess is a combination of both.

I bought my car in one of the covered states, now reside in a non-covered state.

Agree with you on the emission inspections - such a waste. With my move, I went from every other year to annual.

Yes, it is throwing the codes associated with a bad TA and sometimes going into limp mode, so it seems pretty clear it is a TA. They said they wouldn't charge me for the diagnosis if it turns out to be the TA since it would be covered by warranty. I just wanted to make sure it was covered by warranty before asking them to do the diagnosis.

No worries. I'd suggest taking pics of the dash and idrive when the warnings come up and present them to your SA. BMWNA considers that evidence of fault for warranty coverage, at least according to my SA.
