My X5 got hit in the BMW parking lot and they won't look at the video for me. Help!
Apologies if this is not the right place to post this but I'm stuck and want to get advice from you guys.
I was at the dealer(BMW of South Atlanta) getting some parts for my E46. Left the dealer and stopped at Sherwin Williams to get some paint. Got out of the car and saw that it had been swiped. I called the dealer as soon as I saw this and asked them if they could check their video recordings. I was parked right in front of the showroom and there was a camera directly above my vehicle; there's no way it could have missed what happened. I'm not 100% sure on this, but I think the car next to me was a white loaner vehicle. This happened about a week and a half ago. I've called them every day to check and they keep telling me "the server is down, we'll call you back when we can access it, but we have no idea when that will be." This is from the operations manager. I know a police report needs to be filed, but I guess my logic was to do it once BMW pulls the video and sees what happened. Until then, what's the point if the police can't even look at it? And my questions are, how can they not know when their sever will be repaired if it really is down? And how can a business of this size go this long with their servers not functioning? I'm just having a hard time believing their story and I know the video eventually gets overwritten at some point. My fear is that an employee hit me with the loaner and they're hoping I'll just go away. What's my best course of action here? File the police report now? Keep waiting for the server to come back up? |

File a police report. In the report, be honest, you noticed it after you left, but if you werent parked near anyone at the paint place, then the likelihood is the dealership. The dealership will probably give the police the video, but they don't need to necessarily give it to you.

File your police report, get insurance to fix it. Sorry but your damage isn't enough to justify the police hassling the dealer over it.
If it was bad then the cops would on the dealer to provide footage. That's my opinion anyway. Sux that it happened. |

File the report so there is record of the damage. File a insurance claim under UMPD and then let insurance deal with getting their money back, pulling videos, etc, if they want to deal with it. You can file under Collision as well and it wont count against you since your not at fault and parked unless your overall claims history is completely trashed.

Are you sure you can’t rub some of that out with rubbing compound? You may be surprised how effective it can be. I’d first try that with some touch up paint, then wax and forget about insurance altogether.
