09 ED problems with EPA?

Just got this from my dealer:
There is a problem with EPA on 2009 and individuals picking up there cars and driving them for Euro delivery.
Our option if approved is to use a car like yours while u are Germany and urs will be shipped to USA. Obviously you will still get the BMWexperience and delivery just not your vehicle.

Let me know if this would be acceptable to you and we will try to plan according to your wishes.

he should give you more info... what is the 'problem' he is talking about? why is it only for 2009 but not for 2008?

and may be you should ask some other dealers too, to see what they have to say

How can you and your dealer already be talking in this level of detail for ED of a MY2009?

My dealer is still waiting for allocations, pricing, word on changes to 1er ED allocation policy, etc.

Have you actually ordered your car or do you just have a reserved spot?

Nah, with that kind of level, BMWNA would have posted it on their site. With the information at hand, i call it BS. What is the name of your dealership and your CA?

This seems to be a certification problem for very early October deliveries of 09 models.
